Stolen Artwork

Journal Entry: Wed Oct 10, 2012, 5:51 AM

Good morning all my fabulous ghouls!

UPDATE!
China Glaze has formally apologized, and have personally apologized to me - for which I am extremely grateful. They're now going after the so called "artist" who ripped me off, and have offered me compensation, and a job! So rock on China Glaze! And thanks to all of you guys for your support, and the flaming messages sent to the company. I really think that all of the outrage opened their eyes as to what happened, and that caused them to reach out to me. Way to go creeps! I <3 you!

Here is the earlier post:

I have some unfortunate news this morning - I was alerted that the beauty supply company China Glaze has mutilated a few pieces of mine - and some from other artists as well - to advertise their Halloween nail polish collection "Wicked."

This is upsetting, not just because it's a horrendously bad Photoshop job, but because they didn't ask for my permission, or offer any compensation at all. It's disgusting, and I'm pretty hot about it, to say the least.

My illustration can be found here: fav.me/d4ekooa

I've taken the necessary legal steps to resolve it, but I really doubt they'll comply with all my demands. So please, if you see it, don't buy it. I bet that crap just chips off after a day anyway. Ugh.

Thanks to Hachi-kou hachi-kou.deviantart.com/ for the alert, and thanks for your support guys!

Keep creeping,

~A

Looks like some good came out of a really crappy situation. Must give China Glaze major props for fixing the problem and formally apologizing with a note on their website.
I hope the person who was hired to make the piece and ripped you off will get in a load of trouble.

Wow, I'm so happy they resolved this! I noticed on their site that they have a little note on the bottom of the page about this incident. I wouldn't be surprised if they are not being entirely honest about where they got your art. They may just be following the CYA policy, if you know what I mean. Do they have any proof that they hired an artist? Do you even know the artist's name? You may be able to go after that artist legally. I'd sue the shit out of him/her! At any rate, glad China Glaze has made this right with you.

This is my first time hearing about this and I love your artwork I have never heard about this company before but I can grantee you that I will never support this company for what they did. Jerks probably stole artwork from other artistes too they should have their business closed down for this.

Congratulations! I'm so glad you got the better end of this ordeal. No artist ever deserves to have their work stolen.

I'm a little surprised though...China Glaze is a very popular company and that was what they came up with for their Halloween edition nail polish? Good thing they hired you! :) No more phony "artists" trying to rip off other, more deserving people's work. Although I do admire that China Glaze compensated you :)

Best of luck, and I hope your work doesn't get stolen again!

I can't believe such a big company like China Glaze would even TRY that. It's harder to find stolen artwork online in unknown stores and whatnot, but really -- a large nail polish company?! That's ridiculous. I'm happy it's all sorted out!

Yaaay so glad this is sorted out. That kinda stuff INFURIATES ME! How do untalented graphic design thieves get to work for a company like that in the first place? Unfair.
Glad you got a job out of it! Woop and yay.

I didn't read the earlier post, so now is the time for me to go 'WHAAAAAAAAAAAT!' I hope this pseudo-artist is brought to justice. Real, talented artists like yourself never seem to be off the hook when it come to underhanded robbery such as this. On the other hand, it is very good news that the whole situation landed you a job. Rock on China Glaze!

You are VERY lucky that this ordeal ended well. I had something similar happen to me with Rubies' costume company. They were complete jerks and found loopholes to make it so that I barely received enough compensation to pay my lawyer fees. The packages they made are still in circulation, though they stopped producing them. :\

Ugh! That's so horrible! And they're another big company, they could definitely afford to compensate you for that. I'm sorry to hear that... and you're right! I was shocked that China Glaze was so quick and helpful with their response. I think a lot of my fans sent them very upsetting e-mails and flamed their facebook page, so they had to address the issue. I couldn't ask for a better outcome. Though I know now that I might not be so lucky the next time this happens with a less forgiving company. I'm going to have to be on my guard from now on :/

It's really terrible that you had your art stolen and that you had to endure any of this nonsense at all. But I am very happy for you that the art is known to be rightfully yours and that you retain the rights to your wonderful work. Hopefully they'll catch the blockhead who thought it was a good idea to steal the products of someone's hard work and love. Best of luck and I look forward to your new and beautiful works! :)

(Oh. You gave me a little shout out?
////////////////// ...uhhh~ :heart: That's so nice of you! TT U TT )

I'm glad it got resolved, I was afraid it was gonna turn into a huge legal mess. It made me freak out when I saw it in the store... I nearly knocked the display over in my rush to examine it closer. Then I just got mad.

It's refreshing to see a company town up to an error instead of trying to bury the issue. They even went as far as to put that notice on the bottom of their home page. (Which is currently screen-cap'd into my internet scrap book of victory & love forever. - )
I hope the remainder of your interactions with China Glaze are pleasant and prosperous!

I can't thank you enough for bringing it to my attention! I wouldn't have seen it for ages (I only buy OPI nail polish at Sephora) and I couldn't be happier with how they handled it. They were as outraged as I was, and even more so because they paid some hack "artist" to rip me off, and they didn't even know it :/

Thanks again dear! Glad to know you guys have my back!

The Chinese are not respecting intellectual property or copyright laws? Shocking... I hate to say it, but I do not think you will see any compensation in this situation. This is par for the course.

Artists like that never last long.
A friend of mine was working as a background artist in an animation studio not long ago and a new guy got a job doing the same thing, based purely on his portfolio, which after my friend got to see it- turned out to be made completely out of stolen work. But what happened was; every single background he did always turned out terrible and they fired him after one week. He is also blacklisted by every NZ studio.
:D

Good, as he should be! I can't believe it.... as hard as this industry is to get in and stay in, jerks are ripping us off left and right, and it's impossible to keep up! Thankfully their true colors end up showing eventually. Artists work too hard and diligently to put up with this crap.

Yeah, that message
"We would like to actually thank all of you for bringing to our attention the similarity of our Wicked art to that of the talented Abigail Larson. China Glaze had hired an outside contract artist from the LA area to help us develop what we thought was an original piece of art for this collection. We have reached out to Abigail personally as well as our legal team to resolve this issue."
Is at the bottom of their website now, for everyone to see.
They seem like decent people, that got caught up in a bad situation. That "artist" ripped you off, and lied to them. I'm glad that they are going so far as to offer you a job! Do you think you'll take it? Haha.

Haha! Yeah I'm glad they posted it, and they really are good people got taken advantage of because they were in a hurry to get that product on the market. I might take the job, it depends on what they want. They said they'd like to offer me the job to make the label for next October's series, which would be amazing.
